1. Scope

This Privacy Policy describes how ChargeSecured LLC ("ChargeSecured," "we," "us") collects, uses, discloses, and protects information in connection with our merchant-protection platform, checkout-evidence tools, dispute-automation services, merchant portal, and website (together, the "Services"). It applies to merchants, merchant staff and authorized users, cardholders whose transactions are processed through a merchant using the Services, and visitors to chargesecured.com.

2. Information we collect

• Merchant account information: business name, entity type, address, tax identifiers, banking details for payouts, and authorized-user contact information.
• Transaction and checkout information: itemized purchase details, price, timestamps, disclosure and acknowledgement records, and fulfillment or delivery confirmations.
• Cardholder verification information: data used for step-up verification, which may include signature, government ID information, and facial-match data captured at checkout (see Section 7).
• Dispute and evidence records: the evidence packages, reason codes, and case outcomes generated when a dispute is filed.
• Portal usage information: log-in activity, permission and role settings, exports and downloads, and support communications.
• Device and technical information: IP address, browser type, and similar data collected automatically through the Services and our website.

3. How we use it

• To provide, operate, and improve the Services, including risk scoring, disclosure, verification, and evidence capture at checkout.
• To prepare and submit dispute-response and representment packages on a merchant's behalf.
• To generate merchant-facing reporting, analytics, and portal features described in this build (accounting summaries, dispute tracking, and exports).
• To administer accounts, process payouts and fees, detect fraud, and maintain security.
• To communicate with merchants and users about their account, support requests, and service updates.
• To comply with legal, regulatory, and card-network obligations.

4. Sharing & disclosure

We share information as necessary to operate the Services, including with: payment processors and acquiring banks; card networks and issuers (in connection with authorization, verification, and dispute processes); hardware and terminal software providers; service providers who support hosting, analytics, and customer support; and as required by law, regulation, or valid legal process. We do not sell cardholder verification data.

5. Cookies & tracking technologies

Our website and portal use cookies and similar technologies for authentication, session management, and understanding site usage. You can control cookies through your browser settings; disabling certain cookies may affect portal functionality.

6. Payment card data

Card data is handled in accordance with applicable Payment Card Industry Data Security Standard (PCI DSS) requirements. ChargeSecured does not store full, unencrypted card numbers except as strictly necessary to operate the Services and in a manner consistent with applicable PCI DSS scope and requirements.

7. Biometric verification data

Where step-up verification uses signature, ID-document, or facial-match data, we treat this as sensitive information subject to heightened protection. For residents of states with biometric privacy laws — including Illinois' Biometric Information Privacy Act, and comparable laws in Texas and Washington — we provide the required notice, obtain any required consent, apply a defined retention and destruction schedule, and do not sell or profit from biometric identifiers. Merchants deploying verification hardware are responsible for ensuring point-of-sale notices meet local requirements; ChargeSecured provides model language to support that compliance.

8. Data security

We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, or disclosure. No system is completely secure, and we cannot guarantee absolute security.

9. Retention

We retain transaction, evidence, and dispute records for as long as necessary to provide the Services, satisfy card-network retention requirements, resolve disputes, and comply with legal obligations, after which information is deleted or de-identified in accordance with our retention schedule.

10. Your rights under state privacy laws

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, to opt out of certain sharing or "sale" of personal information (as those terms are defined by applicable law), and to be free from discrimination for exercising these rights. This includes rights available under the California Consumer Privacy Act as amended by the California Privacy Rights Act, and comparable laws in states including Colorado, Connecticut, Utah, Virginia, and others as they take effect. To exercise a request, contact us using the information in Section 14; we will verify and respond within the time required by applicable law.

11. Children's privacy

The Services are directed to businesses and are not intended for use by individuals under 18. We do not knowingly collect personal information from children.

12. International transfers

ChargeSecured is based in the United States. If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States and other jurisdictions.

13. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be reflected by an updated effective date, and, where required by law, we will provide additional notice.
